These Terms & Conditions, Refund & Returns Policy outline how Craig Harmer / Seclusion Foundation

(“we”, “us”, “our”) manages bookings, payments, cancellations, and your personal information in accordance with Australian Consumer Law and the Privacy Act 1988 (Cth).

1. Booking & Payment Terms

  • Your retreat booking is confirmed once your deposit has been received.
  • By making a booking, you agree to attend an event hosted by Seclusion Foundation.

Terms & Condition Privacy, Refund & Returns Policy

  • At least 14 days prior to the retreat (if paying via direct deposit), or
  • On arrival, if paying by cash (please note there are no EFTPOS facilities available).

2. Participant Responsibility

  • Participants are responsible for ensuring they are physically, mentally, and emotionally fit to attend the retreat.
  • You agree to take full responsibility for your own well-being during the retreat.

3. Age Requirement

Participants must be 18 years or older to attend the retreat, unless otherwise agreed in writing by Seclusion Foundation. Where an exception is approved, participants under 18 must be accompanied by a parent or legal guardian, who accepts full responsibility for their participation and well-being.

4. Cancellation & Refund Policy

All cancellation requests must be submitted in writing via email to:

  • 21 days or more before the retreat start date:
    Full refund of any monies paid.
  • Less than 21 days before the retreat start date:
    No refunds will be provided. However, your booking is fully transferable to a future retreat date.

This policy is in accordance with Australian Consumer Law, which allows businesses to set fair cancellation terms for services.

5. Transfer Policy

  • Retreat bookings are not transferable to another individual without prior written approval.
  • All transfer requests must be submitted via email and are subject to approval by the Seclusion Foundation.

6. Program Changes

Seclusion Foundation reserves the right to make reasonable changes to:

  • Retreat program
  • Schedule or itinerary
  • Accommodation arrangements

Participants will be notified of any significant changes as soon as possible.

7. Refunds Under Australian Consumer Law

Nothing in this policy excludes your rights under the Australian Consumer Law (ACL).

You may be entitled to a refund or remedy if:

  • The service is not delivered as promised
  • There is a major failure in the service provided

8. Liability Disclaimer

To the extent permitted by law:

  • Participation in retreats and related activities is voluntary and at your own risk.
  • Seclusion Foundation is not liable for any loss, damage, injury, or illness incurred during or after the retreat, including:
    • Personal injury
    • Illness
    • Loss or damage to personal belongings

9. Insurance

Participants are strongly encouraged to obtain appropriate travel and health insurance, including coverage for:

  • Cancellations
  • Medical expenses
  • Personal liability

10. Force Majeure

We are not liable for any delay or failure to deliver services due to events beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Government restrictions
  • Pandemics
  • Acts of God
  • Civil unrest

In such cases, we will work with participants to reschedule where possible.

11. Privacy

We collect and manage your personal information in accordance with the Privacy Act 1988 (Cth).

Your information may be used to:

  • Process bookings and payments
  • Communicate important retreat information
  • Provide updates or relevant offers (you may unsubscribe at any time)

12. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the jurisdiction of the courts of Queensland.
